Terms & Conditions

In exchange for participation in the activity of Fishing/Boat Riding organized by your guide or guides or owners of the business and/or use of the property, facilities and services. I agree for myself and (if applicable) for the members of my family or guest (including minors under the age of 18), to the following:
1. I agree to observe and obey all posted rules and warnings (including all federal, state and local laws), and further agree to follow any oral or written instructions or directions given by your guide, or the employees, representatives, or agents.
2. I recognize that there are certain inherent risks associated with the above described activity (boating, fishing) and I assume full responsibility for personal injury to myself and (if applicable) to my family members (including minors), and further release and discharge for injury, loss, or damage arising out of my or my family’s or guest use of or presence upon the facilities, whether caused by the fault of myself, my family, my guest, or other third parties.
3. I agree to indemnify, defend, and hold harmless my guide, guides or owners of the business against all claims, causes of action, damages, judgment, cost or expenses, including attorney fees and other litigation cost, which may in any way arise from me or my family’s use (including minors), guest or presence upon the facilities.
4. I agree to pay for all damages to the facilities caused by me, my family’s or guest (including minors) negligent, reckless, or willful actions. Includes broken, damaged or lost equipment and damage to the boat. I agree for my credit card on file to be charged for the damages.
5. Any legal or equitable claim that may arise from participation in the above shall be resolved under Tennessee law in Davidson County – Nashville, Tennessee.
6. Safety is our primary concern. If the captain decides the weather is unsafe you may elect to have your fishing trip rescheduled or cancelled. Only the captain can make the decision that the weather is unsafe.
7. We have a fifteen day cancellation policy. If you cancel your trip before fifteen days prior to your trip all of your charges will be refunded. If for any reason you no show or cancel your trip with less than fifteen days prior notice of your trip, you are responsible for payment in full and your credit card will be charged the remaining balance of your trip.
8. Your credit card will be charged the deposit and booking fee.

The owner / owners of this website is in no way associated with any advertiser / guide / charter or person advertising on this website other than being a advertiser. This website is a separate entity and only an advertiser. By agreeing to these terms and conditions you are agreeing to hold the owner / owners of this website harmless and agree to the following Release and Waiver of Liability and Indemnity Agreement

I hereby release, waives, discharges and agrees not to sue the owner / owners of this website (hereinafter referred to as Releasees) from all liability including, but not limited to personal injury, health problems, wrongful death, death, property loss, property damage, any loss and any claim – whether caused by the negligence of the Releasees or otherwise.

I hereby agree to indemnify, defend, save and hold harmless the Releasees from any losses, liability, damage or cost they may incur due to activities by the undersigned associated with fishing charters including but not limited to activities of the undersigned on the Releasees property, the marina, boat launch, access site, state of Tennessee property, lodging facilities or while traveling to or from the fishing charter – whether caused by the negligence of the Releasees or otherwise.

I hereby assume full responsibility for risk of bodily injury, death, and property loss or property damage due to the negligence of Releasees or otherwise.

I agree to allow the Releasees to use photos of the undersigned in any printed and electronic publications without compensation to the undersigned. Photos taken on the Releasees’ camera are the property of the Releasees and may not be used for any publication purposes without written permission from the Releasees.

I further expressly agree that the foregoing release, waiver and indemnity agreement is intended to be as broad and inclusive as is permitted by the law of the state of Tennessee and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

I agree that this document is legally binding on your spouse, children, heirs, next of kin, executors, administrators and assigned parties. I have reviewed the Releasees’ terms and conditions and agrees to abide by those terms and conditions of service. By agreeing, you are agreeing to the release and waiver of liability and indemnity agreement, and further agrees that no oral representations, statements or inducement apart from the foregoing written agreement have been made.
